These Terms of Service ("Terms") form an agreement between you and HostSoch ("HostSoch", "we", "us") for the VPS, cloud server, dedicated server and related services you order from us (the "Services"). By ordering or using any Service, you accept these Terms in full.
1.The agreement
These Terms, our Privacy Policy and the details of each order together make up the whole agreement between us.
We may update these Terms from time to time. The current version is always on this page, with the date it was last changed. Changes take effect when published; if you keep using the Services after that, you accept the updated Terms. We will let active customers know by email about significant changes.
2.Your account
- You must give us accurate and complete details when you sign up, and keep them up to date in the client area.
- You are responsible for keeping your client-area login, server passwords and SSH keys secure, and for everything done through your account.
- Tell us straight away if you think your account or server has been accessed without permission.
3.Orders, payment and renewals
- Pre-paid. All Services are paid in advance. A Service is activated once payment is received, and renewed only when the renewal invoice is paid.
- Prices and tax. Prices are shown in Indian rupees and exclude GST, which is added to your invoice at the applicable rate.
- Billing periods. Some plans show a monthly rate that applies only when you pay for a longer term (for example, 3 years). The rate for other billing periods is shown at checkout.
- Renewals. We send a renewal invoice before each due date. If an invoice is not paid within 5 days of its due date, the Service may be suspended.
- Fees. A late fee may be added to overdue invoices, and a reactivation fee may apply to Services suspended for non-payment or for breaking these Terms.
4.Money-back guarantee and refunds
VPS and cloud servers come with a 30-day money-back guarantee. If you ask for a refund within 30 days of activation, we will refund the amount you paid for that Service.
The following are not refundable:
- Dedicated servers
- Domain registrations and transfers
- SSL certificates and third-party software licences (such as control panel or Windows licences)
The money-back guarantee does not apply if you used our free migration service, bought the Service at a discounted or promotional price, broke these Terms or our acceptable use rules, or were abusive towards our staff.
5.Cancellation
You can request cancellation from the client area or by opening a billing ticket. Please do this before your next renewal date so you are not invoiced again.
Dedicated servers have a minimum term of 30 days. When a Service is cancelled, it is switched off and the data on it is deleted — please take your own copy first.
6.Acceptable use
You may use the Services only for lawful purposes. You must not use them — or allow anyone else to use them — to:
- Host, send or share content that is illegal under Indian law or the law of the country where your server is located
- Distribute pirated software, copyrighted material you do not have rights to, or "warez"
- Host or spread malware, phishing pages, or hacking and cracking tools
- Send unsolicited bulk email (spam), or host websites advertised through spam
- Host pornographic or adult content
- Run open proxies, or launch attacks such as denial-of-service, port scanning or brute-force attempts against other systems
- Resell our Services free of charge
We decide whether something breaks these rules. Serious or repeated breaches — particularly spam, malware, illegal content or attacks — can lead to immediate suspension or termination without a refund.
7.Resources and fair use
Each plan comes with the CPU, RAM, storage and bandwidth shown when you ordered it. Where a plan is described as having unlimited bandwidth or domains, that is subject to fair use: your usage must not harm our network, our hardware or other customers.
If your usage affects other customers or our network, we will contact you by email. In urgent cases we may limit or suspend the affected Service straight away to protect others, and then work with you on a fix — usually moving to a larger plan.
8.IP addresses
- IP addresses assigned to your Service remain ours. They are assigned to you only while the Service is active.
- Requests for additional IP addresses must be justified, as required by internet registry policies.
- You are responsible for the reputation of the IP addresses you use. We may charge for delisting, or withdraw addresses, if they are blacklisted because of activity on your Service.
9.Backups and your data
You are responsible for keeping your own backups of everything stored on your Services.
Backups are available as an optional paid add-on. Even where we take backups, we do not guarantee that they will be available, complete, current or free of errors, and we are not liable for data that is lost or damaged — so please keep independent copies of anything important.
10.Managed and unmanaged services
What our team looks after depends on your plan, as described on our Support page. On every plan you keep root or Administrator access.
You are responsible for changes you or your team make to a server. If such changes cause a problem, we may charge for the time needed to fix it, or ask you to restore the server yourself.
11.Suspension and termination
We may suspend or terminate a Service, with or without notice, if:
- an invoice is unpaid past its due date;
- you break these Terms or our acceptable use rules;
- the Service is being used in a way that threatens our network, hardware or other customers; or
- we are required to by law or by a lawful order from an authority.
Where it is safe and lawful to do so, we will tell you why and give you a chance to fix the problem first.
12.Service availability
We work to keep the Services running at all times, but we cannot promise they will be uninterrupted or error-free. We carry out planned maintenance when it is least likely to disrupt customers and, where possible, give advance notice.
Hardware on dedicated servers is replaced by our engineers if it fails. Any service-level commitments that apply to your Service are those set out in your order.
13.Limitation of liability
To the extent the law allows:
- we are not liable for any indirect or consequential loss, including lost profits, revenue, business or data;
- our total liability for any claim relating to a Service is limited to the amount you paid us for that Service in the three months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law.
14.Indemnity
You agree to compensate us for any claims, losses or costs (including reasonable legal costs) that arise from content you host, your use of the Services, or your breach of these Terms.
15.Governing law
These Terms are governed by the laws of India. Any dispute relating to them or to the Services is subject to the exclusive jurisdiction of the competent courts in India.
